Terms of Service

Welcome to Houseiana. These Terms of Service ("Terms") govern your access to and use of the Houseiana website, platform, applications, and related services (collectively, the "Platform"). By accessing or using Houseiana, creating an account, listing a property, booking a property, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About Houseiana

Houseiana is a platform that enables property owners, hosts, managers, and guests to connect in relation to short-term, temporary, holiday, or furnished accommodation and related services.

Unless otherwise explicitly stated, Houseiana acts as a platform provider and is not the owner, operator, insurer, or direct provider of all listed accommodations. The contract for a stay is primarily between the host and the guest, except where Houseiana is explicitly identified as the direct operator or service provider.

2. Eligibility

To use the Platform, you must:

  • be at least 18 years old;
  • have legal capacity to enter into binding contracts;
  • provide accurate, current, and complete information;
  • comply with these Terms and all applicable laws.

If you use the Platform on behalf of a company, business, or other legal entity, you represent that you are authorized to bind that entity to these Terms.

3. User Accounts

You may need to create an account to access certain features. You agree to:

  • keep your account credentials secure;
  • maintain accurate account information;
  • promptly update any changes to your information;
  • accept responsibility for activity that occurs under your account.

Houseiana may suspend or terminate accounts that contain false information, violate these Terms, or present legal, operational, or security risks.

4. Role of Users

Users may include:

  • guests booking accommodation;
  • hosts listing or offering accommodation;
  • property managers or representatives;
  • other approved users of the Platform.

Each user is responsible for complying with the laws, regulations, licensing rules, tax requirements, and contractual obligations applicable to their activities.

5. Listings and Host Responsibilities

Hosts are solely responsible for their listings and must ensure that all listing content is accurate, lawful, and not misleading.

By listing a property on Houseiana, the host represents and warrants that:

  • they own the property or have full legal authority to list and rent it;
  • the property may legally be offered for short-term or temporary accommodation;
  • the description, images, amenities, location, pricing, and availability are accurate;
  • the property is safe, habitable, and fit for guest occupation;
  • the property complies with all applicable health, safety, building, and licensing requirements;
  • all required permissions, approvals, permits, consents, and registrations have been obtained.

Hosts must not post fake, deceptive, copied, or unauthorized listings. Houseiana may remove, suspend, reject, or edit listings that violate these Terms, create risk, or fail quality or compliance checks.

6. Bookings and Guest Responsibilities

When a guest books a property through Houseiana, the guest agrees to:

  • comply with the listing rules;
  • pay all applicable fees, charges, taxes, and deposits;
  • comply with house rules, booking conditions, and property use restrictions;
  • respect neighbors, common areas, and the property condition;
  • avoid unlawful activity, nuisance, or damage.

Guests are responsible for any damage, excessive cleaning costs, fines, penalties, or losses caused by themselves, their invitees, or anyone accessing the property through them.

7. Payments

Guests agree to pay all applicable amounts shown at checkout, which may include:

  • nightly or daily accommodation fees;
  • service fees;
  • cleaning fees;
  • security deposits;
  • taxes;
  • other disclosed charges.

Note: Houseiana may deduct commissions, service charges, operational fees, payment processing fees, chargebacks, refunds, penalties, or other agreed amounts before remitting payouts.

Payout timing may depend on booking completion, fraud checks, payment processor timelines, disputes, reserve holds, and compliance reviews. Houseiana reserves the right to withhold, delay, offset, or recover funds where reasonably necessary for fraud prevention, chargebacks, refunds, disputes, legal compliance, or breach of these Terms.

8. Cancellations, Refunds, and Changes

Bookings may be subject to cancellation, refund, amendment, rescheduling, or no-show rules set by:

  • the specific listing;
  • the host;
  • applicable law;
  • Houseiana policies.

Refund eligibility may depend on the timing of cancellation, the reason for cancellation, documented issues, payment status, or other factors.

Houseiana may issue partial or full refunds, credits, or booking adjustments where reasonably necessary to resolve disputes, protect users, address property issues, respond to safety concerns, or comply with law.

9. Property Issues, Complaints, and Rebooking

If a guest experiences a material issue with a booking, the guest should notify Houseiana as soon as possible and provide reasonable supporting evidence.

Where appropriate, Houseiana may, at its discretion:

  • request corrective action;
  • offer relocation or rebooking support;
  • provide a partial or full refund;
  • suspend the listing;
  • take other reasonable action.

Houseiana is not obligated to provide compensation beyond what is required by law or by an applicable refund policy.

10. Prohibited Conduct

You must not:

  • violate any law or regulation;
  • provide false or misleading information;
  • impersonate another person or entity;
  • create fake bookings, fake inquiries, or fake reviews;
  • use the Platform to discriminate, harass, threaten, exploit, or defame;
  • damage, scrape, hack, reverse engineer, or interfere with the Platform;
  • bypass fees or conduct off-platform transactions to avoid Houseiana charges where prohibited;
  • upload malicious code or harmful content;
  • infringe intellectual property or privacy rights;
  • use the Platform for illegal or regulatory, unauthorized subletting, parties, or unlawful commercial activity.

11. Reviews, Content, and User Submissions

Users may submit reviews, ratings, messages, photos, descriptions, feedback, and other content.

By submitting content to Houseiana, you grant Houseiana a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, display, and use that content for operating, improving, marketing, and protecting the Platform.

You represent that:

  • you own the content or have the right to provide it;
  • the content is lawful and accurate;
  • the content does not infringe any third-party rights.

Houseiana may remove content that is unlawful, misleading, abusive, irrelevant, or in breach of these Terms.

12. Platform Availability

Houseiana may modify, suspend, restrict, or discontinue any part of the Platform at any time, with or without notice. We do not guarantee uninterrupted access, error-free operation, or continuous availability.

13. Verification and Compliance

Houseiana may conduct identity checks, listing reviews, document verification, fraud screening, securities screening, and other compliance measures.

You agree to provide requested documents or information where reasonably necessary for safety, trust, legal compliance, or operational purposes. Failure to comply may result in delayed payouts, blocked bookings, listing suspension, account restriction, or termination.

14. Intellectual Property

The Houseiana name, logo, platform design, software, text, graphics, trademarks, and other platform content are owned by or licensed to Houseiana and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, frame, scrape, or exploit Platform content without prior written permission, except as allowed by law.

15. Third-Party Services

The Platform may integrate with third-party payment processors, maps, analytics tools, communications providers, and other services. Houseiana is not responsible for third-party services, websites, policies, or failures. Your use of those services may be governed by separate terms.

16. Disclaimers

To the maximum extent permitted by law, the Platform and services are provided on an "as is" and "as available" basis.

Houseiana does not guarantee:

  • the quality, safety, legality, suitability, or availability of any listing;
  • the conduct of any host, guest, or third party;
  • that any booking will meet user expectations;
  • uninterrupted platform access;
  • the accuracy of user-submitted content.

Houseiana does not inspect every property and does not guarantee that every listing is accurate, safe, or compliant.

17. Limitation of Liability

To the maximum extent permitted by law, Houseiana and its affiliates, directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or reputation arising out of or related to the Platform, bookings, listings, user conduct, or these Terms.

To the maximum extent permitted by law, Houseiana's total liability for any claim arising out of or relating to the Platform or these Terms shall not exceed the greater of the amount paid by you to Houseiana in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

18. Indemnity

You agree to defend, indemnify, and hold harmless Houseiana and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your breach of these Terms;
  • your listings, bookings, property, or conduct;
  • your violation of law;
  • your infringement of third-party rights;
  • injury, death, property damage, fines, penalties, or disputes connected to your use of the Platform.

19. Suspension and Termination

Houseiana may investigate violations and may suspend, limit, remove, or terminate access to the Platform, accounts, listings, content, payouts, or bookings at its discretion where reasonably necessary for safety, trust, fraud prevention, legal compliance, or enforcement of these Terms.

You may stop using the Platform at any time. Certain obligations survive termination, including payment obligations, dispute rights, liability limitations, indemnities, and intellectual property provisions.

21. Governing Law and Disputes

These Terms shall be governed by the applicable laws, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts, unless applicable law requires otherwise.

22. Changes to These Terms

Houseiana may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms, updating the "Last Updated" date, or using other reasonable means. Your continued use of the Platform after the updated Terms become effective means you accept the revised Terms.
